2. Scope
These terms apply to all products and services offered by Joann & Sisters, including digital products, templates, guides, diagnostic tools, consulting, recurring support plans and custom services.
By purchasing or using any product or service, the customer agrees to these terms.
3. Nature of the work
Joann & Sisters provides tools, systems and services intended to support clarity, structure and visual consistency.
All work is carried out with care and professional judgment. However, no specific results or business outcomes are guaranteed.
The customer remains responsible for how the provided materials are used.
4. Customer responsibilities
The customer agrees to provide all necessary information, files and approvals required for the execution of the work.
The customer is responsible for the accuracy and legality of all materials provided and guarantees that these do not infringe the rights of third parties.
5. Intellectual property
All intellectual property rights relating to designs, templates, systems, concepts, methods and materials created by Joann & Sisters remain the exclusive property of Joann & Sisters, unless explicitly agreed otherwise in writing.
The customer receives a non-exclusive, non-transferable license to use the delivered materials for their own work or business.
The customer may not:
– resell, distribute or share the materials
– adapt or reproduce them for resale
– use them to create competing products
– grant access to third parties
6. Digital products
Digital products are delivered electronically and may be accessible immediately after purchase.
If the customer is a consumer within the European Union, they normally have a statutory right of withdrawal of 14 days for distance purchases. However, in the case of digital content not supplied on a tangible medium, the customer expressly agrees to immediate performance and acknowledges that, once delivery or access has begun, they may lose their right of withdrawal to the extent permitted by applicable law.
Unless mandatory law provides otherwise, purchases of digital products are non-refundable.
7. Services, custom work and recurring support
Joann & Sisters is only bound to deliver the services that have been explicitly agreed upon.
Any work outside the agreed scope is considered additional work and may be invoiced separately or require a separate purchase.
For custom projects, Joann & Sisters may require written approval, advance payment, or both, before work begins.
If a confirmed project is cancelled by the customer, all work already performed must be paid, with a minimum of 10% of the total quoted amount.
Time spent on review, interpretation, structuring of customer input, feedback and coordination forms part of the service where relevant and may count toward the agreed scope or support capacity.
8. Delivery and timing
Delivery timelines start only once all required materials and approvals have been received.
Delays caused by the customer may affect delivery timing and may result in additional costs.
Quotes remain valid for 30 days unless stated otherwise.
9. Prices and payment
All prices are stated in EUR.
For digital products, payment is required before access is granted.
For services, payment terms are specified in the quotation, invoice, subscription plan or checkout.
For projects above EUR 1,250, Joann & Sisters may require an advance payment of one third of the total amount.
In case of late payment or failed payment, Joann & Sisters reserves the right to suspend ongoing work, withhold delivery, or deactivate access to the relevant service until payment has been received in full.
Applicable legal interest and compensation may be charged for overdue payments.
10. Recurring support plans
Certain services offered by Joann & Sisters are provided as recurring monthly support plans, including but not limited to the Creative Support Plan.
By purchasing such a plan, the customer authorizes recurring payments according to the billing frequency shown at checkout.
Where a fixed commitment period applies, the customer commits to the selected minimum term shown on the product page or at checkout. Cancellation before the end of that minimum term is not possible, unless required by mandatory law.
Recurring support plans cover only the services expressly listed on the relevant product page or service description.
Unless explicitly stated otherwise, any monthly support capacity may be used for conversation, review, interpretation, structuring of incoming material, feedback, implementation and follow-up work within the agreed scope.
Unless explicitly stated otherwise, unused hours, support time or service capacity included in a monthly plan do not roll over to the following month.
Recurring support plans do not include unlimited availability, urgent delivery, or work outside the agreed scope. Any additional work, including but not limited to larger design projects, branding work, website development, publication design, strategic restructuring, extensive rewriting, or work for the customer’s own clients, is excluded and may be quoted or invoiced separately.
Support only starts or continues once the relevant payment has been successfully processed.
If a recurring payment fails, Joann & Sisters may suspend the service until the payment issue has been resolved.
After the end of the minimum commitment period, any renewal, cancellation or continuation of the plan is governed by the conditions shown on the product page, at checkout, in the subscription policy, or otherwise communicated in writing.
Joann & Sisters reserves the right to modify the scope, pricing or conditions of recurring support plans for a future renewal period, provided the customer is informed in advance.
No refund is due for any billing period that has already started, unless otherwise required by mandatory law or expressly agreed otherwise in writing.
11. Liability
Joann & Sisters is not liable for indirect damages, business losses, or consequences resulting from the use or misuse of delivered materials.
Joann & Sisters is not responsible for errors caused by third-party tools, platforms or production processes.
In case of force majeure, Joann & Sisters reserves the right to suspend or terminate services without liability.
12. Complaints
Any complaint must be submitted in writing within 8 days after delivery.
After this period, the delivery is considered accepted.
